Assignment of Lease - Community Land - Eyre Bioregional Permaculture Group Inc

Project Overview

The City of Port Lincoln is seeking community feedback on a proposal to enter into a lease agreement, subject to Ministerial approval, with the Eyre Bioregional Permaculture Group Inc (EBPG) for a portion of land at Allotment 302 Matthew Place, Port Lincoln (Crown Record 6018/141), corner of Mark Street and St Andrews Terrace. Consultation is open from Thursday, 3 April to Thursday, 1 May 2025, 10am.

The EBPG intends to establish a Community Environment Centre on the site, creating a hub for sustainability, education, and community engagement. The proposed development will include:

  • Sustainability and productive systems, including urban forestry, native seed production, and permaculture-based landscaping.
  • Native landscape recovery, with a focus on habitat restoration and biodiversity.
  • Water management, through constructed wetlands for road runoff cleansing and water re-use.
  • Tourism, education, and community resources, providing a space for learning, history, art and science.
  • A nature walk, offering opportunities for environmental education and recreation.

The Community Environment Centre will be a community hub for meetings, plannings, demonstrations, activities and educational programs. The site is adjacent to Greening Australia, a long-term Council lessee, presenting opportunities for shared resources and collaboration such as providing access to the native plant nursery.

In accordance with Section 202 of the Local Government Act 1999 and Council's Public Consultation & Community Engagement Policy 2.63.1, the community is invited to provide feedback on the proposed lease, which includes the following key terms:

  • A lease term not exceeding five (5) years.
  • A peppercorn lease fee of $1.00 per year (excl. GST (if demanded)).
  • EBPG to be responsible for all utilities, taxes, and rates.
  • Ongoing maintenance of the premises to be the responsibility of the EBPG.
  • Any future developments on the site to require Council approval as Land Manager, followed by approval under the Planning, Development and Infrastructure Act 2016.

Community input is an essential part of this process, and we encourage residents to have their say.

  • Council Resolution CO 24/246 - Assignment of Lease - EBPG - 9 December 2024

    That Council:

    1. Notes and receives the proposal prepared by the Eyre Bioregional Permaculture Group Inc. (EBPG) dated 11 October 2024 regarding the use of a portion of land comprised within CR 6018/141 referred to as Allotment 302 Matthew Place, Port Lincoln (Premises) subject to land contamination investigations;

     

    2. With consideration of the proposal received, authorise the CEO or delegate to commence negotiations with EBPG to develop suitable agreements for tenure over the Premises, with the following key terms:

    a. A total term not exceeding five (5) years.

    b. Annual peppercorn lease fee of $1.00 excl. GST (if demanded).

    c. All utilities, taxes, and rates to be on-charged.

    d. Maintenance of the Premises will be the responsibility of the EBPG.

    e. All future proposed developments must be approved firstly by Council as the Land Manager, and then by the authority under the Planning Development and Infrastructure Act 2016.

     

    3. Endorse the proposed lease or licence inclusive of the key terms above be released for public consultation in accordance with the requirements of the Local Government Act 1999 and Council’s adopted Public Consultation and Community Engagement Policy (consultation period to start on 13 January 2025);

     

    4. Endorse the CEO or delegate to notify the Crown Lands Office of the proposed lease and seek Ministerial approval of the lease as per the Crown Land Management Act 2009; and

     

    5. Authorise the CEO to execute the agreements under delegation subject to:

    a. the successful completion of the public consultation process as per Item 3, with successful completion determined by the Chief Executive Officer, who will refer the matter to Council if reasonable community concern is evidenced.

    b. In accordance with Ministerial approval, and any subsequent conditions, that may be required, being obtained as per the Item 4.  

  • Consultation Open - 3 April 2025

    The public consultation period runs from Thursday, 3 April to 10am on Thursday, 1 May 2025 

  • Consultation Closes - 1 May 2025

    The consultation period closes on Thursday, 1 May 2025, 10am

  • Ministerial approval of the lease

    The CEO or delegate to notify the Crown Lands Office of the proposed lease, if no substantial objection from the community is received and seek Ministerial approval of the lease as per the Crown Land Management Act 2009

    CEO to execute the agreement in accordance with Ministerial approval, and any subsequent conditions, that may be required

  • Ordinary Council Meeting - 19 May 2025

    Present and endorse the Consultation Summary Report as a summary of the consultation process, the submissions received, and any issues identifed in the consultation and for the report to be published on Council's website
