City of Port Lincoln By-law Review

Project Overview

The City of Port Lincoln has undertaken a review of its current suite of By-laws, which are set to expire on January 1, 2026. Council By-laws are reviewed every seven years to ensure they remain relevant and aligned with current legislation. The community are invited to provide their feedback on the proposed By-laws from Thursday, 10 April to Friday, 2 May 2025.

The proposed By-laws are based on the existing By-laws and have been updated to reflect legislative changes since their adoption in 2018. The review was conducted with the assistance of Norman Waterhouse Lawyers, and no significant amendments have been made.

The proposed By-laws are:

  1. By-law No. 1 of 2025 - Permits and Penalties – A By-law to create a permit system for Council By-laws, to fix maximum and continuing penalties for offences, and to clarify the construction of Council By-laws.
  2. By-law No. 2 of 2025 - Moveable Signs – A By-law to set standards for moveable signs on roads and to provide conditions for the placement of such signs for the purpose of protecting visual amenity and public safety.
  3. By-law No. 3 of 2025 - Roads 2025 – A By-law to manage, control and regulate certain activities on roads in the Council’s area.
  4. By-law No. 4 of 2025 - Local Government Land – A By-law to manage and regulate the access to and use of Local Government land (other than roads).
  5. By-law No. 5 of 2025 - Dogs – A By-law to limit the number of dogs kept on premises and for the management and control of dogs in the Council’s area.

Council is awaiting the outcome of the State Government’s review of the legislative framework for cats before considering a specific By-law for cat management.

The Draft By-laws are available to review in the Key Documents section on the right or printed copies are available at the Council Office and Port Lincoln Library upon request.

  • Council Resolution CO 25/067 - Council By-law Review

    That Council: 

    1. Authorise the Chief Executive Officer to refer By-law No 5 - Dogs (as attached to the report entitled By-law Review) to the Dog and Cat Management Board for comment in accordance with Section 90(5)(a)-(b) of the Dog and Cat Management Act 1995;

    2. Endorse:

    • Draft By-law No 1 - Permits and Penalties
    • Draft By-law No 2 - Moveable Signs,
    • Draft By-law No 3 - Roads
    • Draft By-law No 4 - Local Government Land, and
    • Draft By-law No 5 - Dogs, (as attached to the report entitled By-law Review)

    for the purposes of public consultation in accordance with Section 249 of the Local Government Act 1999; and that such consultation will commence 21 days after the Chief Executive Officer has complied with resolution no (1); and

    3. Authorise the Chief Executive Officer to make copies of the draft By-laws available to the public in accordance with Section 132(1) of the Local Government Act 1999 (by publishing them on a website determined by the Chief Executive Officer and by providing them in printed form to any person, on request) 21 days after complying with resolution no (1).

  • Refer By-laws to any relevant Government body or agency for comment prior to public consultation

    Refer Draft By-law No 5 - Dogs, to Dog and Cat Management Board for comment

  • Consultation Open - 10 April 2025

    The public consultation period runs from Thursday, 10 April to 10am on Friday, 2 May 2025

  • Consultation Closes - 2 May 2025

    The consultation period closes on Friday, 2 May 2025, 10am

  • Ordinary Council Meeting - 19 May 2025

    Feedback received during the public consultation process will be taken into consideration and any identified amendments will be made to the relevant By-law before being presented to Council for adoption.  If any significant changes are made, Council will again seek community feedback (and any relevant referrals) on the By-laws

  • Legislative Review Committee of Parliament for scrutiny

    Provide adopted By-laws to Legislative Review Committee of Parliament for scrutiny pursuant to the Legislative Instruments Act 1978 - By-Laws prior to 31 August 2025

  • Government Gazette

    A notice of adoption of By-laws 2025 to be placed in Government Gazette. 

    The By-laws will come into operation four months after the day on which it is published in the Gazette in accordance with Section 249(5) of the Local Government Act 1999
