Community Land Licence Agreements - Flinders Park Garden Shed

Project Overview

Pursuant to Section 202 of the Local Government Act 1999, the City of Port Lincoln Community Land Management Plan No. 2 and Public Consultation & Community Engagement Policy 2.63.1, the City of Port Lincoln sought public comment on the proposal to enter into individual Community Land Licence Agreements with the Port Lincoln Multicultural Council and the Port Lincoln History Group to hold tenure over the respective apportionment of the premises, being a portion of Land and Improvements comprised within Certificate of Title Volume 5412 Folio 577 commonly known as Flinders Park Garden Shed with the following key terms.

  1. A total term not exceeding five (5) years.
  2. Annual peppercorn lease fee of $1.00 excl. GST (if demanded).
  3. All utilities and rates to be on-charged based on agreed apportionment between groups.

The public consultation period for this matter ran from Thursday 26 September at 4.00pm and closed on Friday 18 October at 9.00am.

Members of the community were invited to comment on the proposal to enter into Licence Agreements with the Port Lincoln Multicultural Council and the Port Lincoln History Group for both parties to hold individual tenure over the respective apportionment of the premises, being a portion of land known as Flinders Park Garden Shed, for a total term not exceeding five (5) years during the public consultation period which ran from Thursday 26 September to 9am on Friday 18 October 2024.

Council decision

As per the Ordinary Council Meeting held on 29 July 2024, Motion CO 24/032; the CEO will execute the agreements under delegation subject to the successful completion of the public consultation process, with successful completion determined by the Chief Executive Officer, who will refer the matter to Council, if reasonable community concern is evidenced.
