Assignment of Lease - Dog Park Building - Foodbank SA & NT (Foodbank)

Project Overview

The City of Port Lincoln invited community feedback on a proposal to enter into a lease agreement with Foodbank SA & NT (Foodbank) for a portion of land and improvements comprised within CT 5709/805 commonly known as the Dog Park Building. The proposed lease is for an initial term of five (5) years with an option to renew for a further five (5) years following the recently completed expression of interest process for the use of the land and improvements.

Consultation was open from Thursday, 22 May to Friday, 13 June 2025, 10am.

Foodbank plan to establish a local Foodbank at the site — a significant step toward improving food security in Port Lincoln. As living costs rise, more families are facing food insecurity, and this service aims to provide reliable access to nutritious food for those in need.

Foodbank would initially open three days per week, expanding to five days once volunteers are recruited.

The Dog Park Building is considered suitable for the proposed use and planned upgrades are expected to:

  • Improve passive surveillance of the area

  • Enhance public amenities, including upgraded toilet facilities for both dog park users and Foodbank visitors

  • Bring a currently underutilised facility into active community service

Refurbishment works required to meet compliance and operational standards are estimated at $120,000 (excluding GST) and would need to be completed prior to the use of the facility.

In accordance with Section 202 of the Local Government Act 1999 and Council's Public Consultation & Community Engagement Policy 2.63.1, the community wasinvited to provide feedback on the proposed lease, which includes the following key terms:

  • An initial lease term of five (5) years, with an optional renewal period of a further five (5) years.
  • A peppercorn lease fee of $1.00 per year (excl. GST (if demanded)).
  • Foodbank to be responsible for all utilities and rates.

An information sheet on the proposed lease agreement is available in the Key Documents section on the right. Hardcopies were also available at the Council Office and Port Lincoln Library during the consultation period.

  • Council Resolution CO 25/082 - Assignment of Lease - Dog Park Building - Foodbank NT & SA (Foodbank)

    That Council:

    1. Note and receive the submission from Foodbank SA & NT (Foodbank) and accept it as being considered as part of the expression of interest process;

    2. Authorise the CEO or delegate to commence negotiations with Foodbank to develop a suitable agreement for Foodbank to hold tenure over the premises, being a portion of land and improvements comprised within CT 5709/805 commonly known as the Dog Park Building, by lease with the following key terms;

    a) An initial term of five (5) years with an optional renewal period of a further five (5) years.

    b) Annual peppercorn Lease Fee of $1.00 excl. GST (if demanded).

    c) All utilities and rates to be on-charged.

    3. Endorse the proposed lease inclusive of the key terms above be released for public consultation in accordance with the requirements of the Local Government Act 1999 and Council's adopted Public Consultation and Community Engagement Policy; and

    4. Request a further report to be presented to Council upon completion of the consultation period to summarise feedback received and make final recommendation.

    The consultation period closes on Friday, 13 June 2025, 10am

  • Ordinary Council Meeting - 21 July 2025

    Present and endorse the Consultation Summary Report as a summary of the consultation process, the submissions received, and any issues identifed in the consultation and for the report to be published on Council's website.

    Authorise the CEO to execute the lease agreement and associated documentation.

Members of the community were invited to provide their feedback and comments on the Assignment of Lease with Foodbank SA & NT (Foodbank) for the use of a portion of land and improvements commonly known as the Dog Park Building on Puckridge Place during the public consultation period which ran from Thursday, 22 May to 10am on Friday, 13 June 2025.

Council decision

All written submissions received, if any, will now be taken into consideration by Council.

A consultation summary report will be prepared and presented to Council at the Ordinary Council Meeting on Monday, 21 July 2025 for consideration in its decision to enter into a Lease Agreement with Foodbank SA & NT (Foodbank).
